The TQB Group is dedicated to making quality virtual land available to residents of Second Life®. Each region that we offer has been carefully crafted to create a pleasant and enjoyable environment.

Thai Island Paradise offers a variety of residential and commercial properties in a beautiful tropical setting. Most parcels are waterfront and all have access to working water, with many being directly adjacent.


TQB POSH sims have only one land owner per sim for maximum privacy and maximum flexibility in building and terraforming. POSH landowners act as Estate Managers for their own sims, giving them access to the Estate & Region Management tools. POSH sims may be Private Islands with no adjoining sims or Private Regions adjoining one or more of our Thai Island Paradise Private Reserves, for direct access to our developing network of waterways.

Our standard residential, commercial and mixed-use sims all have a 5% prim bonus, at no additional cost. Our building codes are designed to give land owners maximum flexibility in developing their land while encouraging “good neighbor” building.

Prim Parcels are found on our standard residential, commercial and mixed-use sims. These parcels may be purchased to provide 245 prims for use on other land with the same owner on that sim. Please see our Covenants (below) for usage guidelines for prim parcels.

Our low-prim Private Reserves offer more space at a very reasonable price. Available  in Thai Island Paradise with 2, 3 or 4 islands sharing a low-prim sim; each island has it's own extended water space. These parcels are perfect for the person who wants more room but doesn't need a lot of prims. Please see the note below concerning the use of low prim sims.

Our Private Region sims are ideal for the person who wants the privacy of their own sim while being part of a larger community; your nearest neighbors are in another sim! Available as low-prim (3750 prims) or full-prim (15000 prims). Please see our Zoning & Building Codes, listed below, for additional details.

The epitome in Second Life land ownership is the Private Island Sim. You get ownership of 65,536sqm of virtual land to develop to suit your wishes. Available as low-prim (3750 prims) or full-prim (15000 prims). Private Island Sims have no adjoining sims unless the owners wish it.

Please note: Low-prim sims (called "Homestead" regions by Linden Labs) share CPU and server resources and are subject to usage restrictions. "Homesteads are intended for low density rentals, quiet residential, or light use".
They support a maximum of 20 avatars and may have yet-to-be-determined script limits. We will include those limits here when Linden announces them.

AGREEMENT

• Purchasing land in an estate owned by the TQB Group or TertiumQuid Becloud constitutes agreement to these Terms of Service.
• You agree that the TQB Group is providing you with virtual land ownership in Second Life.
• You agree that the TQB Group is the Estate/Sim Owner and you are the Landowner.
• You are responsible for canceling your own subscription if needed.


TERMS

• This agreement is solely between you and the TQB Group; this agreement is NOT with Linden Research, Inc. (Linden Lab), the owners/operators of Second Life.

• Our obligations and your obligations under this agreement end as soon as you sell, transfer your land to another resident or release your land; our obligations also end at any time that you are in default of any portion of this agreement.


BUYING / OWNING LAND

• Pay a one time purchase price and pay a monthly maintenance (tier) fee, either through a tier fee subscription via PayPal® or through a tier management box.

• The purchase price is paid in Lindens (L$) in Second Life and will include the first month's tier fee, unless you request that the first's month's tier be paid through a PayPal subscription.

    o If the purchase price paid in L$  does NOT include the first month's tier, the tier fee subscription must be established, via PayPal, within 1 hour of  purchase. If the initial tier payment is NOT made within 1 hour the sale will be cancelled and no refund of the purchase price will be paid.

    o After you have paid your first month's tier with your purchase in L$, you may establish a tier payment subscription through PayPal by going to the "TIER PAID WITH PURCHASE" page on this website within 4 hours of purchase. The first subscription payment will be made one month from the date that you create the subscription.

    o If you are unable to obtain a PayPal account or prefer to pay your tier in L$, we will set up a tier management box to accept your tier payments. and credit it with the first month paid with purchase. Tier paid in L$  includes the fee charged by Linden Labs to exchange L$  to  US$on the Lindex and is higher than tier paid in US$. Since the exchange from L$  to US$  changes, the tier rate will also change.

    o IMPORTANT NOTE: If you purchase land in our estates from a previous buyer, not from TertiumQuid Becloud or the TQB Group, and you fail to make your first tier payment within 4 hours, your land will be forfeit & no refund will be issued.


• Land transfers for L$0 are considered private party sales. Failure to report a private party sale or transfer may result in the forfeiture of your land.

• You do not pay any tier fees to Linden Lab for land purchased from the TQB Group. A premium membership is NOT required for ownership of land in our estates.

• Ownership is permanent providing that Tier Fees are paid, these Terms are not violated and the Building / Zoning Codes (see below) are adhered to.

• The TQB Group land ownership system is independent from Linden Lab’s land ownership system. Land purchased through the TQB Group is guaranteed and serviced solely by the TQB Group.

    o ABOUT OUR MONTHLY MAINTENANCE (TIER FEES): Our payment tiers are graduated, which means that the monthly tier for a 4096sqm parcel is less than double that of a 2048sqm parcel, for example. This is based upon a single Tier Payment Subscription (or Tier Management Box, for payments in L$) for all land with the same owner. If land payments are split, for any reason, between Tier Payment Subscriptions, Tier Management Boxes or any other payment method, each payment is treated as individual and at the standard rate for that parcel size.
        • If a payment being split results in a payment rate not found on our Tier Schedule, the payment rate is subject to a 2% surcharge.
        • Payments for land on Homestead sims are graduated separately from payments for land on full prim sims.

• Land Exchange Fee: Landowners who wish to exchange land owned in a TQB Group estate for land of equal or smaller size will be charged a L$100 processing fee. The TQB Group reserves the right to waive this fee at our discretion. Exchanges to larger parcels do not incur a processing fee.

• Landowners agree to adhere to the Building / Zoning Codes for their region.

• Landowners are granted full access to their land to use and build and full access to the parcel controls.

• All support and/or technical issues for land purchased from the TQB Group will be handled by the TQB Group in a timely fashion.  Contact us at: tqbgroup@earthlink.net.


PAYMENTS

• Tier payments are due each month on the same day as your original payment date.

• Tier payments made in L$  may be paid several months in advance.There is no discount for paying in advance in L$.

• Tier payments made in US$  may be paid in advance through a PayPal invoice. Please contact TertiumQuid Becloud to request an invoice for advance payment. Advance payments in US$  through PayPal invoice are discounted as follows:
    3, 4 or 5 months: 1%     6, 7 or 8 months: 2%     9, 10 or 11 months: 3%     One year or longer: 4%

• Advance payments for land on low-prim (Homestead) sims are NOT eligible for a discount.

• There will be a 3 day grace period with late payments after which you shall be in default and your agreement with the TQB Group shall be terminated. Termination is effective at midnight between the 3rd & 4th day. Upon termination all rights to the land are revoked and all personal items will be returned to you. NOTE: There is no grace period if you have terminated your tier subscription or deleted/returned the tier management box.

• If you are paying through a tier box you are responsible for remembering to pay on time. The TQB Group is not obligated to remind you.

• If you have a temporary problem making your tier payment on time, special arrangements may be made at our discretion. Send a notecard to TertiumQuid Becloud in world or an email to tqbgroup@earthlink.net. Be specific as to how much of an extension you are requesting. Extensions should be requested prior to your tier falling into arrears. We will respond to your request as quickly as possible. As stated, extensions are at our discretion and are not guaranteed. Factors such as prior payment history will be considered. If you do not receive a response prior to your tier falling into arrears, send a second request to tqbgroup@earthlink.net, NOT an in world notecard.

• Tier boxes for tier payments in L$  are located at our Land Center in Krung Thep http://slurl.com/secondlife/Krung%20Thep/80/106/21.

• Tier boxes for payments in L$  were placed on the Landowner’s land prior to the establishment of our Land Center. If a tier box is placed on your land, it must be set to the same group as the land, if any, or the "All Residents" box must remain checked for "Run Scripts" under the "Options" tab for the land settings and you may not delete or return the tier box. If the box is deleted, returned or the scripts disabled, we reserve the right to place the box in our Tier Payment Center and require future payments to be made there.

• If you sell, transfer or abandon your land, you are responsible for cancelling your PayPal subscription.


• If you move to a larger parcel on a TQB Group  owned sim, any tier remaining on the smaller parcel will be fully credited to the tier for the larger parcel. If you move to a smaller parcel, 10% the remaining tier (minimum L$100) will be retained as a processing fee and the remainder credited. If you move to another parcel and do not abandon the parcel you have moved from AND inform TertiumQuid Becloud by notecard that you have moved, tier will accrue on both parcels until such time as as the land is abandoned and notification is made or is reclaimed by the TQB Group..


• The TQB Group is not responsible for Tier Fees paid after termination.

• Payments should be made through a verified PayPal account. The TQB Group is not responsible for fees that have been paid without a verified PayPal account.



SECOND LIFE ToS

• The Second Life ToS and Code of Conduct will be applicable on your land; you need a valid Second Life account to be able to visit your land. Should your Second Life account be cancelled for any reasons, payments already made are nonrefundable.


SELLING YOUR LAND

• Prior to listing you land for sale you must give notification to the TQB Group. You may list your land for sale in the land listing tools of Linden Lab. You may not violate the Building Code (see below) to facilitate the sale of your land. If you have joined one or more prim parcels to other parcels you may be required to subdivide them back to their original configuration prior to sale.

• Do not terminate your PayPal subscription or delete the tier management box prior to the sale of your land; if you terminate your subscription or delete the box prior to selling your land and the monthly tier payment comes due, your land will be forfeit.

• If you set your land for sale, there is no grace period for late tier payments. If the tier payment becomes past due, your land will be forfeit.

• You may sell your land to any other Second Life account holder, regardless of account type, at any rate agreed upon by you and your buyer. The new buyer must establish a tier payment subscription or make a payment to a tier management box for that land within 4 hours of purchase.

• Purchase of a TQB Group land constitutes explicit agreement to these Terms of Service.


REFUNDS

• We do not issue refunds on paid initial costs or tier fees, whether paid in US$or L$, except as noted:
   
   
o If you pay your tier in L$  in advance, we will refund for full months paid in advance past the first full month upon determination that transfer of the prepaid tier to the new owner was not part of the terms of sale. Refunds for tier paid in L$  are subject to a L$3000 processing fee.

    o If you pay your tier in US$  in advance, we will refund for full months paid in advance past the first full month upon determination that transfer of the prepaid tier to the new owner was not part of the terms of sale. If the advance payment was discounted, the discount will be recalculated for the shortened period and the refund will be adjusted accordingly. PayPal fees that we paid on the initial transaction will be deducted from refunded monies. Refunds for advance tier payments that were not discounted are subject to a US$12 processing fee. Refunds for discounted advance tier payments are subject to a US$35 processing fee.

• We do not refund monies due to you not being verified with PayPal.

• We do not refund monies for land ownership terminated for cause.

• We may or may not purchase land back from you at our discretion.


ACCESS / TQB GROUP STAFF

• TQB Group Staff must have access to your land at all times.

• TQB Group Staff shall not be subjected to abuse by landowners or their guests.

• Denial of access or abuse of TQB Group is a breach of this agreement.

• TQB Group Staff will use IMs, Note cards and optionally email to inform landowners of violations of these Terms of Service or the Covenant. Muting TQB Group Staff is therefore not recommended. Refusal of a note card from TQB Staff shall constitute a breach of these Terms of Service.


COVENANTS

The following may also be found in the Covenants for our Estates, along with elements that are specific to an Estate or to individual sims within an Estate.


COVENANT for TQB POSH

All land owners are entitled to the quiet enjoyment of their land.

Each land owner is also an Estate Manager, giving them access to the Estate & Region Management tools.

If the land or estate level access/ban feature is used, TQB Group Staff must be on the allowed list.
 
If your sim adjoins another sim that is not TQB POSH and your sim is set for public access, any security systems used must allow a minimum of 30 seconds for intruders to leave. If your sim does not adjoin another sim you may use whatever time limit you prefer. Please note that extremely short warning times on security-protected areas of public access sims may discourage visitors from visiting non-restricted areas.

If you use a security system,
TQB Group Staff must be on the allowed list.

There will always be a minimum of 2 TQB Group staff assigned as Estate Managers in TQB POSH to lend additional assistance to our landowners here. The assigned managers may be changed at our discretion.

If your land is on a low-prim (3750 prims) sim, be aware that these exist 4 to a server and share the server resources. Just as over use of scripts can lag a full prim sim, over use of scripts will lag a low prim sim, only a lot sooner. Use scripts wisely.

If the landowner of TQB POSH sim elects to have their sim adjacent to a sim in another TQB Group estate, you may be required to maintain a 12m perimeter parcel that must set to public access.


COVENANT for THAI ISLAND PARADISE

CONDUCT

All parcel owners are entitled to the quiet enjoyment of their land.

• No stalking or harassment of any kind.

• No nonconsensual player vs. player combat.

• No littering of objects on other residents' land.

• No screenshots without permission of land owners or sim management.

• No flying up to other residents' skyboxes without permission.

• No attempts to bypass or thwart other residents' bans or security systems.

• Adult content on residential parcels must be kept inside private structures.

• No public nudity. Public nudity is defined as nudity which can be casually seen from the average ground level or a structure on another parcel. Nudity that can be seen only by flying or climbing to the top of an intervening hill is not public.

• Avatar load: Full prim sims are able to support a maximum of 100 Avatars at one time; the Linden Lab default for full prim sims is 40.
Homestead sims are able to support a maximum of 20 Avatars at one time. At half the maximum possible load (50/10), the sim will experience lag. A sim that is near the maximum limit will lag badly. Our full prim sims are set to a limit of 40 for Residential Only sims, 60 for Mixed-Use sims and 80 for Commercial sims. We may increase those limits temporarily for special events when requested in advance in a note card.

The number of Avatars that can be on a parcel without abusing sim resources and causing lag depends on the type of sim, size of the parcel and how many Avatars are on other parcels on the same sim at that time; for this reason we do not set a specific number of Avatars per parcel. Do not regularly overload your parcel with Avatars. If the number of Avatars on a parcel interferes in any way with the use of other parcels on that sim or in any other way is detrimental to the sim, that parcel is overloaded. When a sim reaches the Avatar limit, other residents on that sim will be unable to enter the sim; other landowners will be unable to access their parcels. The TQB Group reserves the right to reduce Avatar load on a parcel as needed.

ZONING / BUILDING CODES

Zoning and building codes must be adhered to for the benefit and enjoyment of all owners / occupants of the regions in an estate. Violations will result in 1 warning being given in Second Life® and/or by email. Violations must be corrected within a reasonable time (as determined by the TQB Group) of notification being sent. Egregious violations, violations which directly impair another land owner's use of their land or violations which adversely impact the sim will be corrected by TQB staff without notice and may result in temporary or permanent termination of land ownership.

Public Adult content is not permitted in regions not classified Adult.

The use of the land Access feature is not permitted on any land purchased after June 7, 2007. Security scripts or systems may be used that 1) do not hinder access to other parcels in the sim and 2) give visitors ample warning and enough time (30 seconds, minimum) to leave the parcel before being teleported. The ban list may be used providing the persons banned are not residents on the same or immediately adjacent sims.

Security systems for skyboxes may have less than 30 seconds warning provided they do not not affect AVs below 250m.

Subdivision of parcels on our residential, mixed-use or commercial sims is permitted as long as all parcels created are in increments of 1024sqm and no parcel is created which is smaller than the minimum size specified for that sim. Private Reserve and Private Region parcels may not be subdivided without explicit prior approval by TertiumQuid Becloud.

Use of of megaprims is subject to prior approval by TertiumQuid Becloud. Due to the potential for oversized prims to cause problems, approval, if granted, will be for specific uses only. Older vintage megaprims have been known to crash sims. At this time, megaprims from Builders Brewery appear to be safe to use. Megaprims must not extend off of the owner's land..

Land owners may terraform their own land within the height change limits set for their sims, with care taken to preserve the overall appearance of the sim. Waterways between neighboring parcels may not be eliminated without prior approval. Terraforming at or near parcel borders must not alter adjacent parcels. Special terraforming conditions apply to Private Reserves and Private Region or Private Island sims that adjoin other sims (see below). All terraforming is subject to approval by the TQB Group. The TQB Group may correct unacceptable terraforming at any time without notice.

The "Edit Terrain" box under the "Options" tab for "About Land" may not be left checked in the absence of the land owner or other person with the ability to uncheck it.

SPECIAL NOTE ABOUT TERRAIN TEXTURES: Terrain textures are set sim wide. It is not possible to change or adjust terrain textures for individual parcels. Once land has been sold on a sim, the terrain textures will NOT be changed except for (1) seasonal changes in the Western Territories or (2) a unanimous request by all the landowners on a sim. The TQB group is a landowner on all sims except those in TQB POSH and will have the final say on terrain texture changes.

Any additional covenant elements that are specific to a sim will be listed by sim name in the covenant for that estate in Second Life.


FOR ALL SIMS EXCEPT PRIVATE REGION AND PRIVATE ISLAND SIMS

BUILDING CODE
o    No public sandboxes.
o    No flying structures below 400m altitude, effective 15 September 2009. Existing skyboxes over land purchased before 15 September do NOT have to be raised. New skyboxes must be at or above 400m.
o    No signs, billboards or rotating prims (unless previously checked and approved by the TQB Group).
o    Buildings must have adequate distance from parcel border (if unsure, ask).
o    No major eyesores.
o    To preserve a consistent landscape, terraforming is subject to approval by the TQB Group.
o    No skirting of the terraforming limits by creating false landscapes with prims.

OBJECT CODE
o    No spy scripts.
o    No vendors on noncommercial parcels.
o   No scripts that transmit data directly or indirectly to external databases unless explicitly permitted by the TQB Group.
o    No abusive scripts. Overuse of temp rezzers is script abuse.
o    No high lag scripts. Scripts with very high run times are high lag.
o    No abusive objects. Objects with high lag scripts or high numbers of potential collisions that adversely effect sim performance will be considered abusive.

OBJECTS WHICH SEVERELY DEGRADE SIM PERFORMANCE OR THREATEN TO CRASH THE SIM MAY BE RETURNED WITHOUT NOTICE. THE TQB GROUP BEARS NO LIABILITY FOR DAMAGE TO OBJECTS RETURNED UNDER THESE CONDITIONS.

EFFECTIVE 10 OCTOBER 2009: Objects which reproduce and move around may not be brought on to any TQB Group owned homestead sim or any sim in Thai Island Paradise or the Western Territories, with the exception of single parcel sims. This includes but is not limited to Sion Chickens, S-Design Turtles and all similar objects. Please note that homestead sims share CPU recources with other homesteads and LL may impose script and/or usage limits at any time. If limits are imposed that require the removal of objects covered by this section, the TQB Group bears no liability for any damage or loss resulting from their removal.

SPLODERS, MONEY EXPLODERS, ETC: Sploders (etc) that only pay out to persons that have paid in are gaming devices and are prohibited by Linden Labs. Please note: calling a required payment a donation does not fool anybody.
Sploders (etc) that do not require a payment to participate may only be used if they do not adversely impact the sim. TQB group staff shall determine if a sploder is adversely impacting a sim and may disable or return it without notice. Sploders whose sole purpose is to game a parcel's traffic figures are prohibited by LL.

EXCEPTIONS
o  Exceptions may be allowed if residents in the sim unanimously agree and those changes don't effect the experience in other sims.


ADDITIONAL FOR RESIDENTIAL SIMS

BUILDING CODE
o    Residential builds only.
o    No high-rise structures unless previously approved (if unsure, ask).


ADDITIONAL FOR MIXED USE SIMS

Specific commercial use(s) will be approved by the TQB Group prior to any land being sold. The approved uses(s) for each sim are listed by name in the Estate Covenant, following the general codes. Any commercial use other than the specified approved use(s) is a violation of this covenant & the Terms of Service. Commercial land that is resold may only be used for the specified commercial use(s) or for noncommercial residential use. Precautions shall be taken to prevent the clients of commercial establishments from interfering with the residential owners' quiet enjoyment of their land. Commercial land owners are responsible for the conduct of their customers.

BUILDING CODE
o    No unapproved commercial uses.
o    No high-rise structures unless previously approved (if unsure, ask).


ADDITIONAL FOR COMMERCIAL SIMS

Commercial land owners are responsible for the conduct of their customers. Activities prohibited by Linden are prohibited by the TQB Group. Residences may be built on commercial sims with the provision that complaints about businesses by residential owners will be cheerfully ignored; reports of illegal activity will be investigated.


ADDITIONAL FOR PRIM PARCELS

• May not be terraformed without prior approval.
• May not be joined to another parcel without prior approval.
• Must remain open for access by everyone.
• Objects must be above 400m or below the surface.
• Structures on submerged parcels must remain at least 1m below the surface.
• Sea life may not impede access.


ADDITIONAL FOR PRIVATE RESERVES

NOTE: Private Reserve sims are low prim (3750) waterspace sims divided into 2, 3 or 4 separate islands, each with it's own extended waterspace. To preserve everyone's privacy & space, the overall size or height of the individual islands may not be substantially increased. Private reserve sims have an outside border of public water and public waterways across the sim, to allow free travel throughout the sim and the estate. Private reserves share the server resources. Just as overuse of scripts can lag a full prim sim, over use of scripts will lag a low prim sim, only a lot sooner. Use scripts wisely.

Private Reserve parcels may not be subdivided for resale.

Private Reserve sims will be either Residential or Commercial, but not both.

GENERAL
o Private Reserves are mostly water; the land mass provided may not be increased beyond it’s original footprint or moved without prior permission from TertiumQuid Becloud, Sarit Becloud or a Senior Property Manager.
o May not be subdivided.

BUILDING CODE
o No high-rise structures unless previously approved (if unsure, ask).

OBJECT CODE
o    No script abuse.
   
EXCEPTIONS
o No exceptions


ADDITIONAL FOR PRIVATE REGION SIMS (3750 PRIMS)

NOTE: Private regions are on Homestead sims and share server resources. Just as over use of scripts can lag a full prim sim, over use of scripts will lag a low prim sim, only a lot sooner. Use scripts wisely.

GENERAL
o These sims are mostly water; the land mass provided may not be increased beyond it’s original footprint or moved without prior permission from TertiumQuid Becloud, Sarit Becloud or a Senior Property Manager.
o The TQB Group will retain an  easement around the perimeter of the sim to facilitate movement between the sims in the estate. This easement is not included in the “sqm” sold and does not effect the prims available to the land owner.
o May not be subdivided.

BUILDING CODE

o No high-rise structures unless previously approved (if unsure, ask). All structures must be on the dry land with possible case-by-case exceptions for appropriate small structures immediately offshore. Please ask prior to building in the water. Large yachts are considered structures and may not be placed offshore. If you wish to have a large yacht on your sim, please ask us to submerge a large enough section of your land to accommodate it.
o Terraforming is subject to approval by the TQB Group.

o We allow wider latitude in terraforming 3750prim Private Regions with the smaller (11,712sqm) water border easement as long the original footprint of the land is not exceeded.
o Terraforming of the 3750prim Private Regions with the 16,320sqm water border easement is permitted as long as the land height is not raised more than 1m. The original footprint of the land may not be exceeded.
o No skirting of the terraforming limits by creating false landscapes with prims.
o Land height may not exceed 8m above sea level.
o The original terraforming on a private region sim may include prim elements that extend the usable dry land or a land height greater than 8m above sea level. If you delete these prims or chose to reterraform, the Building Codes listed above will apply.
